1. Scope

These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) apply to all legal transactions concluded via the online shop www.laschocards.ch (hereinafter referred to as “LaschoCards”).

The online shop is operated by Merz Collectibles GmbH, based in Wettingen, Switzerland, which acts as the contractual partner for all legal transactions.

LaschoCards reserves the right to amend these Terms and Conditions at any time and without prior notice. For orders placed via the online shop, the Terms and Conditions valid at the time the order is placed shall apply.

By placing an order in the online shop, customers accept these Terms and Conditions and confirm that any conflicting or deviating terms and conditions shall not apply, even if LaschoCards was aware of them at the time the contract was concluded.

The products offered in the online shop are intended for private use and are sold in quantities customary for private households.

2. Contract Language

All legal transactions are conducted in German. Information provided in other languages is non-binding. Only the information provided in German shall be authoritative.

3. Product Information

3.1 Images

All images of products displayed in the online shop, on social media (Facebook, Instagram, etc.), in brochures or advertisements are for illustrative purposes only and are non-binding.

3.2 Prices

Prices are stated in Swiss francs (CHF), including statutory VAT and excluding delivery costs. LaschoCards may change prices at any time and without prior notice. The price applicable at the time the contract is concluded shall be binding.

3.3 Availability and Delivery

LaschoCards endeavours to provide up-to-date information regarding availability and delivery times in the online shop. However, production or supply shortages may result in delays or cancellations. Information regarding availability and delivery times is non-binding. Partial deliveries are excluded – orders will be shipped once all items are available.

3.4 Pre-Orders

Quantities ordered as part of pre-orders cannot be guaranteed. Reductions in quantities supplied by the manufacturer or unforeseen circumstances may result in cancellations. Such cancellations will be processed based on the order in which orders were received, with lower order numbers being prioritised.

If additional items are ordered together with pre-order items, all items will be shipped together once all items included in the order are available. We do not offer partial deliveries.

3.5 Condition of Sealed Products

Sealed products may show irregularities in the seal, wrapping or packaging resulting from production, packaging or transportation. These may include, for example, loose or uneven wrapping, sealing seams, minor creases, pressure marks, small tears or comparable variations. Such minor variations do not constitute a defect provided that the product remains properly sealed and the function or contents of the product are not affected.

Customers who place particular importance on the visual condition of the seal or packaging are advised to add the paid “Sealed Check” service to their order.

3.6 Sealed Check Service

When the paid “Sealed Check” service is purchased, LaschoCards will inspect the seal of the relevant product before shipment and, where multiple units are available, select at its reasonable discretion a unit with the cleanest and most intact seal possible.

Even when the Sealed Check service has been purchased, a completely perfect seal or packaging cannot be guaranteed due to production-related variations. The service does not constitute a guarantee of any particular condition or quality of the seal.

4. Conclusion of Contract

The products displayed in the online shop constitute an offer. However, this offer is subject to product availability and correct pricing. A contract is concluded when the customer places an order through the online shop and LaschoCards confirms the order.

The confirmation acknowledges receipt of the order but does not guarantee that delivery can be fulfilled.

4.1 Technical Errors

LaschoCards accepts no liability for incorrect prices or product information displayed in the online shop as a result of technical or system errors. In such cases, LaschoCards reserves the right to cancel or correct orders.

5. Payment

All payments are made in Swiss francs (CHF) and are generally due immediately upon conclusion of the contract.

LaschoCards accepts the following payment methods:

TWINT, Visa, Mastercard, Shop Pay, Apple Pay, Google Pay, PayPal and purchase on account with an instalment payment option (POWERPAY).

The “purchase on account” payment method is provided by MF Group / POWERPAY as an external payment service provider. The individual invoice allows online purchases to be paid conveniently by invoice. If payment is not made within the specified period, POWERPAY will issue a monthly invoice in the following month containing an overview of the purchases made.

When a purchase contract is concluded using the “purchase on account” payment method, POWERPAY acquires the resulting receivable and independently handles the corresponding payment arrangements. LaschoCards assigns the receivable to POWERPAY.

When using the “purchase on account” payment method, the General Terms and Conditions of POWERPAY apply in addition to these Terms and Conditions. They are available at https://www.powerpay.ch/de/agb and are expressly accepted by selecting this payment method.

6. Delivery

Delivery Area

Delivery is made exclusively within Switzerland and Liechtenstein.

Shipping Method

Orders are shipped by Swiss Post Ltd (hereinafter referred to as the “Post”).

Shipping / Packaging Costs

Shipping and packaging costs vary depending on the product category and are shown separately when placing an order. LaschoCards covers the shipping costs for orders with a value of CHF 120 or more.

Orders placed by 4:00 p.m. are generally shipped on the same day. However, longer processing and delivery times may occur due to high order volumes, pre-orders, public holidays, supplier delays or other unforeseen circumstances. Any stated delivery times are therefore non-binding estimates and cannot be guaranteed at all times.

LaschoCards reserves the right to charge customers for additional shipping costs if such costs arise.

Liability During Shipping

Upon handover of the goods to the Post, the risk of loss or damage passes to the customer. LaschoCards accepts no liability for lost or damaged shipments unless an insured shipping option has expressly been selected. To protect against loss, customers are advised to select an insured shipping method.

Retention of Title

The delivered goods remain the property of LaschoCards until payment has been made in full. In the event of non-payment, LaschoCards reserves the right to take legal action to recover the goods.

7. Warranty

The statutory warranty provisions apply. Customers must inspect the goods immediately upon receipt and report any defects to LaschoCards within seven days.

At LaschoCards' discretion, warranty claims may be fulfilled by:

• Replacement with an equivalent product

• Credit for the purchase price

• Free repair

• Reduction of the purchase price

No warranty is provided for wear parts.

8. Right of Withdrawal / Returns & Cancellations

As a general rule, there is no right of withdrawal or return, except in the case of incorrectly delivered products. In such cases, customers have the right to report the issue and return the product within seven days of receipt.

Customers may request the cancellation of their order after prior consultation with LaschoCards, provided that the order has not yet been processed or shipped. There is no entitlement to cancellation. A processing fee of 9% of the order value may be charged for each approved cancellation in order to cover incurred payment and administrative costs.

In the event of a cancellation voluntarily approved by LaschoCards, LaschoCards shall decide whether the remaining amount, after deduction of any applicable processing fee, is refunded to the original payment method or credited in the form of store credit. Customers have no entitlement to a particular method of reimbursement in the case of voluntarily approved cancellations.

Orders that have already been processed or shipped can no longer be cancelled.

Pre-orders cannot be cancelled in all cases. In particular, if the goods have already been bindingly ordered from the supplier or reserved for the customer, LaschoCards reserves the right to reject a cancellation request. If a cancellation is exceptionally accepted, the above provisions regarding the processing fee and method of reimbursement shall also apply.

If cancellation is no longer possible and the goods are delivered, there is no right of return or withdrawal after receipt of the goods unless a statutory warranty claim applies.

Any refunds or reversals required by law remain unaffected by these provisions.

9. Limitation of Liability

LaschoCards shall be liable in accordance with the applicable statutory provisions, but shall not be liable for slight negligence, indirect damages or consequential damages, including loss of profit or damages resulting from delivery delays.

LaschoCards shall not be liable for damage resulting from improper storage, improper use or improper repair, or for damage caused by force majeure.

10. Data Protection

Customers are responsible for ensuring that the information provided during registration and when placing an order is accurate and complete. Personal login details must be treated confidentially.

LaschoCards handles submitted data with the greatest care and uses it exclusively for processing orders. Customers agree that their data may be used for internal marketing purposes and may only be disclosed to service providers (e.g. shipping partners) where necessary for order processing. LaschoCards accepts no liability for damages resulting from the loss, unauthorised disclosure or theft of customer data.

11. Copyright

All rights to the content of the online shop, including texts, designs and images, belong to their respective rights holders. Any unauthorised further use, reproduction or other use without consent is prohibited.

12. Severability Clause

Should individual provisions of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

13. Applicable Law and Jurisdiction

Swiss law shall apply exclusively. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. The place of jurisdiction shall be Baden, Switzerland.
